1. Introduction & Acceptance
These Terms of Service (the “Terms”) govern your access to and use of the Profit and Quit LLC website and evaluation programs (collectively, the “Services”), offered by Profit and Quit LLC, a Texas limited liability company (“Profit and Quit,” “Company,” “we,” “us,” or “our”). These Terms incorporate by reference our Privacy Policy, our Risk Disclosure Statement, and any Program Rules published at checkout (together, the “Supplemental Policies”).
By creating an account, purchasing an evaluation, or otherwise using the Services, you enter into a binding agreement with Profit and Quit LLC and agree to be bound by these Terms. If you do not agree, do not use the Services.
The Services are intended only for individuals who are at least 18 years old and legally capable of entering into a binding contract. By using the Services, you represent that you meet this requirement.
2. Definitions
Account means an evaluation account or funded account issued to you under these Terms. Plan Type means the evaluation track you select at checkout — currently Builder, Rapid, Rapid EOD, or Pro — each with its own minimum trading days, Consistency Rule, funded-stage drawdown mode, profit split, and payout cadence, as published on our Pricing page. Consistency Rule means the rule under which no single trading day may account for more than a published percentage of a participant’s total profit; the percentage, and whether the rule applies at the funded stage, vary by Plan Type. Drawdown means the maximum loss threshold applicable to an Account, calculated on an End-of-Day (EOD) or intraday trailing basis depending on Plan Type. Evaluation Account means a simulated account used to assess whether a participant meets the requirements to advance to the funded stage. Program Rules means the profit target, drawdown, Consistency Rule, minimum trading days, and other parameters published for a given Plan Type and Account size at checkout, as updated from time to time. List Price means the standard, non-discounted price published for a given Plan Type and Account size, shown struck through alongside the discounted price on our Pricing page and each Plan Type page. You or User means the individual using the Services.
3. Modifications to These Terms
We may amend these Terms at any time. Material changes will be reflected by an updated “Last Updated” date at the top of this page. Continued use of the Services after a change constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
4. No Investment Advice; Not a Broker
Nothing in the Services constitutes investment advice, and Profit and Quit LLC does not provide guidance, instructions, or recommendations regarding how you should trade. No employee, contractor, or representative of Profit and Quit LLC is authorized to provide investment advice, and any statement to the contrary is disclaimed. Profit and Quit LLC is not a broker-dealer, futures commission merchant, introducing broker, or investment adviser, and does not trade on your behalf. All trading decisions made within our Services are solely your own.
5. Eligibility & Account Registration
You must provide accurate, current, and complete information when registering and at checkout, and promptly update it if it changes. Before receiving a payout or an invitation to the live-capital stage, you may be required to complete identity verification. We may suspend or terminate an Account where submitted information cannot be verified or is found to be false, misleading, or incomplete. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.
6. Evaluation Program
Evaluation Accounts require participants to reach a published profit target while staying within a published maximum drawdown, using an End-of-Day (EOD) trailing drawdown calculation, over the minimum trading days published for the selected Plan Type (currently one day for Builder, two days for Rapid and Pro, and four days for Rapid EOD). There is no maximum time limit to complete an evaluation on any Plan Type. During the evaluation stage, the Consistency Rule applies at the percentage published for the selected Plan Type. Program Rules published for future purchases may be updated, but changes will not be applied retroactively to reduce the rules disclosed to you at the time of your purchase.
7. Funded Stage
Participants who complete an evaluation move to the funded stage at the same account size and Plan Type. The Consistency Rule does not apply once an Account reaches the funded stage, except on the Builder Plan Type, where it continues to apply at the funded stage as published on our Pricing page. Funded-stage Accounts also operate in a simulated environment and remain subject to the applicable drawdown, calculated on an EOD or intraday trailing basis depending on Plan Type. Funded participants who meet applicable eligibility requirements may request a payout on the recurring cadence published for their Plan Type (daily or bi-weekly), subject to the terms and payout policies in effect at that time. Profit splits of up to 90/10, which vary by Plan Type, are disclosed in full at checkout.
8. Live Capital / Funded Trader Program
Participation in the evaluation or funded stage does not guarantee an invitation to trade live capital. Profit and Quit LLC may, at its sole discretion, invite funded participants who meet additional eligibility criteria to trade live capital. No account size, rule set, purchase, or level of performance entitles a participant to such an invitation, and we reserve the right to modify, suspend, or discontinue any live-capital offering at any time.
9. Fees & Payment
All fees are due in full at checkout on a one-time basis; Profit and Quit LLC does not currently offer recurring-subscription plans. Fees are non-refundable except where required by applicable law or as set out in any refund policy we publish. There is no activation fee to move from the evaluation stage to the funded stage. Payment is processed by a third-party payment processor; we do not store full payment card numbers.
The price displayed for each Plan Type and Account size reflects a promotional discount of 50% off the List Price, applicable to a participant’s first purchase of that Account type. The List Price is shown struck through alongside the discounted price at checkout. Any account purchased after a participant’s first purchase is priced at the then-current List Price unless a different promotion is published and applied at checkout. The discount percentage and List Price are promotional and subject to change at any time without notice; the price and discount in effect at the time of checkout govern that purchase.
10. Account Limits & Non-Transferability
A User may hold up to five Accounts at any time, across any combination of Plan Types and Account sizes we offer. We may publish additional limits on the number or size of Accounts a User may hold from time to time.
Accounts are personal to the individual who completed identity verification and may not be sold, shared, sublicensed, transferred, or combined with another person’s Account performance, trading history, or data, except as expressly permitted when advancing from the evaluation stage to the funded stage. Operating an Account on behalf of another person, or permitting another person to operate yours, is prohibited.
11. Dormant Accounts
An Account that shows no trading activity for an extended period, as defined in our published Program Rules, may be deemed dormant. We reserve the right, in our sole discretion, to treat a dormant Account as closed, consistent with the Program Rules in effect at the time.
12. Prohibited Trading Practices & Conduct
The following are prohibited on any Profit and Quit Account and may result in disqualification without refund: opening offsetting or hedged positions across two or more of your own Accounts, or across Accounts held by different individuals acting in coordination, to guarantee an outcome or circumvent risk limits; registering or operating an Account under a false identity or on behalf of another person; exceeding published Account Limits, or using multiple accounts to mirror, copy, or coordinate trades in a manner that manipulates simulated results; exploiting a platform, pricing, or software error rather than promptly reporting it to us; engaging in trading activity that is manipulative, abusive, erratic, or inconsistent with ordinary risk management; interfering with or attempting to gain unauthorized access to our platform or the accounts of other Users; using the Services for any unlawful purpose; and harassing, threatening, or abusing our staff, other Users, or third parties.
We may review trading activity on any Account. Where prohibited conduct is identified, we may, in our sole discretion, disqualify the Account without refund, remove the affected trades from your results, suspend or terminate your Account, and pursue any other remedy available to us.
13. Data & Trading Activity
You acknowledge that we have access to all trading activity, orders, and account data generated through your use of the Services (“Account Data”), and you grant us the right to collect, analyze, retain, and use Account Data for internal operations, compliance, and risk-management purposes, and, in de-identified or aggregate form, for research and marketing. You are not entitled to compensation for our use of Account Data.
14. Intellectual Property
All content on our website and platform, including text, graphics, logos, trademarks, and software, is owned by Profit and Quit LLC or its licensors and is protected by applicable intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to access and use our website for your own non-commercial evaluation and funded-trading purposes. You may not reproduce, distribute, modify, or create derivative works from our content, or use our name or marks, without our prior written consent.
15. Third-Party Services
Our Services may reference or link to third-party platforms, payment processors, or other services not controlled by Profit and Quit LLC. We are not responsible for the content, accuracy, or practices of any third-party service, and your use of them is at your own risk and subject to their own terms.
16. Risk Disclosure
Trading futures involves substantial risk of loss and is not suitable for all individuals. By using the Services, you acknowledge that you have read and understood our full Risk Disclosure Statement, which is incorporated into these Terms by reference, including its hypothetical-performance and no-guarantee-of-profit disclosures.
17. Warranties Disclaimer
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PROFIT AND QUIT LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY MARKET DATA DISPLAYED THROUGH THE SERVICES IS ACCURATE, COMPLETE, OR TIMELY. NO REPRESENTATION IS MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE DISCUSSED ON OUR WEBSITE.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PROFIT AND QUIT LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR SIMULATED TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO PROFIT AND QUIT LLC FOR THE ACCOUNT GIVING RISE TO THE CLAIM.
19. Indemnification
You agree to indemnify, defend, and hold harmless Profit and Quit LLC and its officers, employees, contractors, and affiliates from any claims, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
20. Force Majeure
We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, acts of government, pandemics, power or internet outages, or failures of third-party platforms or payment processors. Our obligations affected by such an event are suspended for its duration.
21. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms, the Program Rules, or the Consistency Rule and drawdown limits. Fees are non-refundable upon termination except where required by applicable law. Provisions that by their nature should survive termination, including intellectual property, indemnification, limitation of liability, and dispute resolution, will survive.
22. Waitlist Program & Drawing
Joining our waitlist is free and does not require a purchase. Waitlist members are eligible to receive a promotional discount off the List Price of their first evaluation, at the percentage displayed on our Waitlist page at the time of signup; the discount is tied to the email address used to join and may be time-limited or modified for future signups.
Waitlist members are also entered into a periodic drawing for one complimentary evaluation reset. No purchase is necessary to join the waitlist or to be entered into the drawing. One entry per person; winners are selected at random, notified by email, and announced at Profit and Quit LLC’s discretion. The drawing is void where prohibited by law and open only to individuals who meet the eligibility requirements in Section 1. Odds of winning depend on the number of entries received. Profit and Quit LLC may modify, suspend, or discontinue the waitlist program or drawing, or the discount percentage offered, at any time.
23. Geographic Restrictions
You may not access or use the Services if you are located in, are a resident of, or are otherwise subject to the laws of a jurisdiction where our Services are prohibited, or if you are subject to sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) or similar authorities. You represent that you are not subject to any such restriction.
24. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved through individual, binding arbitration administered by a mutually agreed-upon arbitration provider (or, absent agreement, the American Arbitration Association) seated in the State of Texas, rather than in court, except that either party may bring an individual claim in small claims court where it qualifies. You and Profit and Quit LLC each waive the right to participate in a class, collective, or representative action. Either party may seek injunctive relief in a court of competent jurisdiction pending arbitration.
25. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
26. Notices
We may provide notices to you electronically, including by email or through the Services. Notices are deemed received when sent.
27. Entire Agreement
These Terms, together with the Supplemental Policies, constitute the entire agreement between you and Profit and Quit LLC regarding the Services and supersede any prior agreements on the same subject.

Profit and Quit LLC offers funded futures trading evaluation programs. Evaluation and funded-stage accounts operate in a simulated trading environment; participants who meet funded-stage requirements may be invited, at Profit and Quit LLC’s sole discretion, to trade live capital subject to additional eligibility criteria. No representation is being made that any account will or is likely to achieve profits or losses similar to those discussed on this site, and past or hypothetical results are not indicative of future outcomes.
