2. CFTC Rule 4.41 — Hypothetical Performance Disclosure
Evaluation accounts, and funded-stage accounts, operate in a simulated trading environment and do not involve the execution of trades in a live futures market. Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Because these trades have not actually been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated or hypothetical trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those discussed on our website or in our marketing materials.
3. No Guarantee of Funding, Invitation, or Profit
Completing an evaluation, or meeting any published profit target or rule set does not guarantee an invitation to trade live capital, continued access to a funded account, or any level of profit. All funded-stage and live-capital opportunities are offered at Profit and Quit LLC’s sole discretion and subject to additional eligibility criteria that may change at any time.
4. Evaluation & Funded Accounts Are Not Brokerage or Investment Accounts
An evaluation account or a simulated funded account is not a brokerage account, is not funded with your own capital, and does not represent an investment of any kind. Fees paid for an evaluation are paid for access to our evaluation program and simulated trading environment, not for the purchase of securities, futures contracts, or any other financial instrument. Funds used in a simulated account are not real and cannot be withdrawn as such; access to a simulated account does not entitle you to payment based on simulated results except as expressly provided under a funded-stage payout policy we publish.
5. Regulatory Status
Profit and Quit LLC is not a broker-dealer, futures commission merchant, introducing broker, or investment adviser, and does not provide brokerage, investment, or advisory services. Nothing on our website or in our communications should be construed as an offer or solicitation to buy or sell any futures contract or other financial instrument.
6. Market Data & Third-Party Information
Market or trading data made available through our Services is provided “as is” and may be delayed, incomplete, or inaccurate. We do not warrant the accuracy, completeness, or timeliness of such data and are not responsible for decisions made in reliance on it.
7. Live Capital Discretion
Any live-capital trading opportunity extended to a funded participant is offered entirely at Profit and Quit LLC’s discretion and may be modified, paused, or discontinued at any time, including after an invitation has been extended, subject to the terms in place at that time.
8. Program Rules Subject to Change
Profit targets, maximum drawdown levels, the Consistency Rule, payout cadence, profit splits, and other program rules are published at checkout and may be updated for future purchases. Changes to program rules will not be applied retroactively to reduce the rules disclosed to you at the time of your purchase, except where necessary to comply with applicable law.
